1. Introduction
Welcome to Nudge. These Terms govern your access to and use of our iOS application, website, AI task planning tools, reminders, notifications, and related services. By accessing or using the Services, you agree to be bound by these Terms.
2. Eligibility and Accounts
You must be at least 13 years old to use the Services. Certain features may be available without an account, while sync, backup, subscriptions, or cross-device access may require one. You are responsible for your account credentials and all activity under your account.
3. Task, Reminder, and Planning Content
You retain ownership of tasks, notes, checklists, reminders, schedules, categories, priorities, transcripts, URLs, phone numbers, locations, and other content you create. You grant Nudge a limited license to process that content only as needed to provide, maintain, secure, and improve the Services.
4. AI Features
Nudge may use AI to create tasks, summarize plans, suggest priorities, update tasks, generate follow-up check-ins, and transform natural language into structured planning data. AI-generated results may be inaccurate or incomplete. You are responsible for reviewing, editing, approving, rejecting, or deleting AI-generated output before relying on it.
5. Local Storage, Sync, and Backup
Nudge may store task and planning data locally on your device. If sync or backup features are available and enabled, your data may also be stored on our servers, cloud providers, or platform services. We are not responsible for data loss caused by device failure, user deletion, operating system behavior, disabled permissions, network issues, or third-party outages.
6. Subscriptions, Billing, and Purchases
Some features may require a paid subscription or purchase. Subscription pricing, billing periods, trials, renewals, and available features are disclosed at purchase. App Store purchases, renewals, cancellations, refunds, and payment management are handled by Apple and subject to Apple's terms.
7. Acceptable Use
You may not use the Services for unlawful, harmful, abusive, fraudulent, deceptive, or malicious purposes, interfere with or overload the Services, attempt unauthorized access, upload harmful code, scrape or resell the Services without permission, or use the Services to support illegal activity or harm.
8. User Responsibilities
You are responsible for the accuracy of information you enter and for confirming dates, times, deadlines, locations, reminders, and task details. Nudge is not for emergencies, critical safety situations, medical decisions, legal deadlines, financial deadlines, or any situation where failure of a reminder or suggestion could cause serious harm.
9. Intellectual Property and Third-Party Services
The Services, design, software, code, features, branding, logos, text, graphics, interfaces, and workflows are owned by us or our licensors. Third-party services may have their own terms, policies, fees, limitations, and availability rules.
10. Termination, Disclaimers, and Liability
You may stop using the Services at any time. We may suspend or terminate access if we believe you violated these Terms or created risk. The Services are provided as is and as available. To the maximum extent permitted by law, our total liability is limited to the greater of amounts you paid in the 12 months before the claim or $100.
